The ever growing complexity of employment related law is posing a major headache for many employers. No matter how hard you try,
you will struggle to comply, especially in the personal grievance area. Employment law over the last 35 years has itself grown into a complex body of law with hidden perils abound. The depth and complexity of employment law now means small to medium size businesses need human resource related knowledge and specialist employment law knowledge just to ensure they remain compliant. These businesses cannot justify employing a Human Resource Manager at the going rate of $80k - $150k salary per year.Companies with 10 – 100 staff need some level of HR experience. Even larger organisations with their own HR Managers/ HR Departments are finding themselves being criticised by the Courts in terms of their lack of understanding of the legal requirements. Employers often end up paying out money to employees who have raised personal grievances. Some pay to get rid of the problem, even when their liability is limited. They do this because the time and cost involved in defending their actions is uneconomical. Others pay to fix a legitimate complaint which occurred through a misunderstanding of the employer’s obligations. To an employer both of these situations are almost always avoidable by obtaining the relevant advice on how to deal with an issue before it gets out of hand.
Based on recent case law we have expanded our service into providing objective based advice and representation, especially in relation to disciplinary investigations relating to employees. Our last newsletter explained in depth the complexity involved in the disciplinary investigation process. This is valuable because an employer, no matter how cheesed off they are with a worker, will nevertheless be required to remove from their minds, all emotive thoughts and retain an objective and open mind.
