Third Eye 2011 Ltd has been established and will operate out of Gary Tayler Ltd’s office and is for employers. It is owned and operated by Adrian Tayler who is also an employer’s advocate.
The services provided by Third Eye are twofold.
- It provides and monitors a covert and overt camera surveillance service which includes the sale of and installation of various types of camera systems which according to price and need, can be tailored to meet the individual needs of the client.
Camera installation can be by way of permanent rental by the client off Third Eye or outright purchase.
- The second service is the covert and remote monitoring of workplace computer and hard drive retrieval where information has been deleted from a computer.
Why the need for such a service? It is simple. When investigating
employees who are suspected of misconduct or serious misconduct in regards to computer use or general dishonesty, there is no more powerful a tool than evidence of the truth. It is amazing how memories which are otherwise clouded in terms of misbehaviour, immediately return with clarity followed by admissions.
Factual information relied upon by an employer to sanction an employee is far more likely to satisfy the Court than evidence of an ‘honestly held view based on reasonable grounds’. That legal principle is very elastic depending on who the judicial decision maker is. It can also make the difference between a dismissed employee for serious misconduct being entitled to legal aid or not.
How often we hear the words of the mediators (correctly I add) telling us to settle for money on commercial sensible grounds. “Pay $5,000.00 to make it go away”.... “The applicant is on legal aid so even if you win you cannot claim costs and you will be left with your own $6,000 -$7,000 account.”
Litigation is very uncertain and often the winner is not the wrongdoer but rather the person who performed the best on the day.
Factual footage of evidence of wrong doing relied upon is an invaluable tool and can make the difference between an employer standing its ground or caving in to pressure to pay out large sums of money to end litigation.
